Terms & Conditions for Alive Luxe Experiences
These Terms and Conditions govern your booking with Alive Luxe Experiences, operated by Alive Group LLC ("we", "our", "ALX"). By making a booking, you agree to be bound by the provisions set forth below. Please read them carefully.
Contract
We draw your attention to the terms and conditions of travel below. These terms and conditions, including all brochures, documents, correspondence, and the terms and conditions of our suppliers, form the basis of the contract with you (collectively, “Terms and Conditions”). Before making a booking with us, you must ensure that you have read and understood these Terms and Conditions, and raise any questions you may have with us. Please be aware that these Terms and Conditions contain waivers of liability, as well as waivers of class action and venue selection and notice clauses.
By asking us to confirm your booking, you are:

Representing and warranting to us that you agree with them.
All contracts made with ALX are made subject to these Terms and Conditions.
Group Bookings
If you are making a booking as a group:

The group leader is responsible for sharing these Terms and Conditions with all members of the group.

The group leader is financially responsible for the booking.
-
We will not be liable for a group leader’s failure to share these Terms and Conditions with all travelers in their group.
Representations and Warranties
You represent and warrant that:

You are of sufficient age to use our services and website, and can create binding legal obligations in connection with your use.

You are legally authorized to act on behalf of those you represent and accept these Terms and Conditions on their behalf.

The information supplied by you or members of your group is true and correct.
Violations by You
You agree that any violation of these Terms and Conditions may result in:

The cancellation of your reservation or purchase,

The forfeiture of any monies paid for your reservation or purchase, and
-
You being denied access to the applicable travel-related product or service.
Introduction
ALX offers tailored, luxury travel packages designed to provide unique and unforgettable experiences for our clients. The services provided by ALX are subject to the terms and conditions outlined in this document, as well as those of any third-party service providers (e.g., airlines, hotels, and tour operators) whose services are included in your itinerary.
Scope
ALX does not provide, own, manage, operate, supervise, or control the travel services and products that are or may be provided as part of your trip, such as flights, accommodations, cruises, rental cars, packages, or travel insurance (the “Travel Products”). All Travel Products are owned, controlled, operated, or made available by vetted, independent third parties such as destination management companies, airlines, hotels, cruise lines, and tour operators (the “Suppliers”). The Suppliers are solely responsible for the Travel Products as well as any and all benefits, perks, or amenities, including, without limitation, resort credits, on-board credits, free specialty dining, spa credits, in-room amenities, etc. The Supplier’s terms, conditions, and privacy policies apply to your booking, so you must agree to and understand those terms. Your interaction with any Supplier is at your own risk; ALX does not bear any responsibility should anything go wrong with your booking or during your travel.
Hence, as the traveler, you agree that ALX acts only as an agent for the traveler in acquiring transportation, hotel accommodations, cruises, sightseeing, and other Travel Products, privileges, or services for the traveler’s benefit, and on the express condition that ALX shall not be responsible for any act, omission, negligence, bankruptcy, insolvency, or default of any Supplier, company, or person engaged in or responsible for any Travel Products, or otherwise in connection therewith.
Please review all documents, including the cancellation policies and terms and conditions of the Suppliers, carefully and promptly as we will not be responsible for any errors. It is your responsibility to review all travel documentation and alert us as soon as possible of any corrections.
Booking Process
At ALX, we believe that every journey is an opportunity to create unforgettable memories infused with luxury, wellness, and mindfulness. Our award-winning travel designers are dedicated to meticulously crafting bespoke trips that reflect your unique interests and desires. With our extensive knowledge of the world’s most exquisite destinations and a commitment to holistic experiences, we curate a full-service travel experience that not only indulges your senses but also nurtures your mind and spirit.
As you embark on your adventure with ALX, we seamlessly integrate wellness and mindfulness into every aspect of your trip, from rejuvenating spa retreats to serene nature immersions. Every detail is managed with the utmost attention and sophistication, ensuring that your journey transcends the ordinary. Allow us to transform your travel experience into something extraordinary, where each moment is defined by elegance, well-being, and peaceful reflection.
Step 1: Initial Introductory Call
After completing our experience design form, your service begins with a complimentary introductory call with one of our travel experts. This is your opportunity to share your vision for the perfect safari experience and discuss the unique adventures you seek. During this call, feel free to ask any questions about our services and the breathtaking destinations within Africa we offer, allowing us to tailor your journey to your specific desires.
Step 2: Customized Itinerary Creation
Following the complimentary introductory call, our team will create a personalized travel itinerary designed just for you. This will incorporate everything we discussed, including your budget, interests, and preferred travel style and experiences. As with any other professional service, we value our time and expertise, and as such, we charge a non-refundable consultation and planning fee, structured according to the number of guests traveling:

$250 for 0-6 guests

$500 for 6-10 guests

$1000 for more than 10 guests
This commitment fee will be applied to your final trip cost. Should you decide not to proceed with booking or cancel your holiday, the full commitment fee will be forfeited. This fee helps cover the time spent in developing your bespoke itinerary and experience.
Step 3: Finalizing Your Itinerary
Once we receive your commitment fee, we will create a fully customized itinerary for your review and approval. We will continue working with you to ensure every detail meets your expectations and vision. We encourage travelers to provide as much information as possible regarding their desired experiences, preferences, and the atmosphere they wish to create. This enables us to craft a deeply personal and life-changing journey.
Repeat Travelers: We do not charge a commitment fee for repeat clients, as you are already familiar with our process and what to expect from our services.
Step 4: Confirmation & Deposit
Once your final itinerary is approved, a 50% deposit is required to confirm your booking. This deposit secures your hotels and services for the selected dates and itinerary. Payment options include wire transfer or credit card, and we accept all major credit cards. A 3.5% processing fee will be applied to credit card payments.
Please note the following additional conditions:

Peak Season and Lodging Requirements: In certain cases, lodges or hotels may require full payment at the time of booking, particularly during peak travel periods like the Winter holidays.

Booking Within 90 Days: For any trip booked within 90 days of your departure date, full payment will be required at the time of booking.

Final Balance Payment: The balance is due at least 90 days before your first day of travel, although this may vary depending on your itinerary and destination. Some lodges may have different policies that require earlier payments.
Please also be aware that your itinerary may be adjusted after deposits are made to accommodate further changes, such as upgrades, date changes, or adjustments to services. Your final itinerary, including all travel details, will be sent to you 14 days prior to travel.
Quotes & Costs
Quoted prices are in USD and typically per person sharing, double occupancy, except where indicated. Prices include planning, handling, and operational charges and are based on current rates of exchange, tariffs, and taxes in effect at the time of publication. ALX reserves the right to increase prices to cover increased costs, tariffs, taxes, and VAT received after prices are published and to reflect fluctuations in foreign exchange markets. ALX is under no obligation to give a breakdown in costs of any journey. Modification of group experiences to accommodate a smaller group size will not affect the published program price.
Included Services
The following is intended to be indicative only. ALX accepts no liability for any mistakes or errors in the calculation of the advertised price, which is based on the anticipated costs of the particular experience. An ALX sample itinerary on the website will typically include the following services in the advertised price:

All internal (domestic) flights and accommodations as noted in the basic itinerary; all meals as specified; arrival and departure transfers; Meet & Greet on international arrival; sightseeing, park and entrance fees; local bottled water during sightseeing; selected beverages with group meals; local taxes.

Cape Town experiences – the services of an ALX Customer Experience Coordinator during your stay in Cape Town.
Excluded Services
The following services are excluded unless otherwise specified in the basic itinerary:

Unforeseen Circumstances/Changes to Itineraries and Services
ALX reserves the right to make changes to its published itineraries which we deem insignificant and are due to reasons beyond our control. In such cases, we will arrange for the substitution of comparable services.
Occasionally, due to circumstances beyond our control (e.g., weather, political instability, operational changes), it may be necessary to alter your itinerary or substitute services. While we make every effort to minimize these changes, you acknowledge and agree that such modifications may be made to ensure the safety and enjoyment of your trip. We will notify you as soon as possible if any significant changes occur and will offer alternatives where feasible.
Accommodations, including vessels and trains, and arranged sightseeing are subject to change at any time due to unforeseen circumstances or circumstances beyond ALX’s control. While no changes are anticipated, there may be occasions when certain alterations become necessary. These can be due to religious holidays, national celebrations, seasonal closures, or unforeseen events including weather, governmental closures, acts of God, or any other reason. ALX reserves the right to change the itinerary due to such unforeseen circumstances or emergencies. Additionally, historic sites undergo renovations from time to time which can obscure viewing or otherwise change the nature of visiting these sites. No trips will be cancelled due to renovations, although ALX may choose to amend itineraries for such sites. These changes will not be considered a material change and will not be considered cause for cancellation by the guest.
If we suggest alternate activities in place of a planned stop or in case of leisure time, such suggestions do not constitute our endorsement. In such a case, you will be subject to the terms and conditions of the Supplier of the activity, and your only recourse in case of damage will be against the Supplier of the alternate activity.
Weather Conditions and Wildlife Sightings Disclaimer
ALX is not responsible for any activities, excursions, or tours that are unable to take place due to adverse weather conditions, natural disasters, or other circumstances beyond our control. This includes, but is not limited to, delays, cancellations, or modifications of scheduled activities. Where possible, we will make every effort to reschedule affected activities or offer alternative arrangements, but this cannot be guaranteed.
Furthermore, when participating in safari or wildlife tours, while every effort will be made to provide a fulfilling experience, sightings of animals cannot be guaranteed. Wildlife is unpredictable, and sightings are subject to natural behavior and environmental factors. ALX does not assume responsibility for any failure to observe specific animals during the safari or wildlife tour. Travelers acknowledge and accept these risks as part of their booking and participation in such activities.
Special Requests and Preferences
If you have any special requests (e.g., dietary restrictions, accessibility needs, or specific accommodations), we will do our best to accommodate them. However, please note that these requests are not guaranteed and are subject to availability and the terms of the third-party suppliers. We recommend that you inform us of any special requirements as early as possible to ensure the best chance of meeting them. Please note that while every effort will be made to secure a special request, it cannot be guaranteed in advance of travel.
Meals are as indicated in the itineraries. Special diets should be requested at the time of booking; however, it may not be possible for special diets to be catered to in some of the destinations we feature. For safety and liability reasons, ALX and its representatives cannot be responsible for directly accommodating any food allergies, or dietary requirements and restrictions, and are not responsible for any issues or problems associated with the same. We will advise the Supplier of your request, but we cannot guarantee their availability.
Health and Safety
You are responsible for ensuring that you are in good health to travel and that you are capable of participating in all activities planned during your trip. We strongly recommend that you undergo a medical check-up prior to travel, particularly if you have any pre-existing medical conditions. Some destinations may require vaccinations or other health precautions (such as malaria prevention). You are encouraged to consult a healthcare professional to ensure you are fit to travel and have taken all necessary precautions.
Some active elements have been incorporated into select experiences. To enjoy those experiences as intended, a minimum level of fitness is required. ALX will require notice if any participant has any physical or other condition or disability that could create a hazard to him or herself or to other members of the group. ALX reserves the right to decline acceptance of anyone whom it considers unsuitable due to fitness level. Should you have any questions or need any clarification about a specific program, please ask ALX concierge for details at the time of booking.
International Airfares
International airfares are not typically included in experience pricing. ALX has special agreements with flight specialists and can offer quotations from any gateway. Please ask your Adventurist for details.
All international and internal air quotes are subject to change and can carry penalties and surcharges until final payment has been received by ALX. Flight confirmation is based on availability. Please note that certain airfares are subject to a service fee.
Airlines concerned are not to be held responsible for any act, omission, or event during the time passengers are not on board their planes or conveyances. These experiences may use the services of any IATA carrier. International air carriers are subject to international air conventions limiting their liability. The limitations of liability are contained on the reverse side of the airline ticket or e-ticket receipt, or on the carrier’s website, and form part of the terms and conditions of this package. The passage contract in use by these companies, when issued, shall constitute the sole contract between the companies and the purchaser of these travel programs and/or passage.
These tickets are linked to contracts (‘Air T&C’) which are very complex and can entail very strict requirements regarding changes, airport and departure taxes, and cancellation and baggage provisions. The Client MUST read ALL the applicable conditions BEFORE paying for the ticket. The Client should also take note that if your flight/itinerary consists of more than one flight/coupon/ticket, the Client is not allowed to use such tickets/coupons out of sequence or to ‘skip’ one (e.g., opting for train, bus, or car transport) as this will VOID the entire balance of the journey/itinerary. ‘No-shows’ may result in the ticket being voided and/or the Client being charged a cancellation fee. Any right of recourse the Client may have will be solely against the airline in terms of the Air T&C. Loyalty programs are governed by strict rules, of which the Client must be aware, and retention of boarding passes and other documentation pertaining to such programs is the sole responsibility of the Client. Consult the Company about refunds for unused tickets, as strict deadlines apply.
Baggage Fees
Due to ongoing changes in airline baggage policies, we recommend checking directly with your airline for the most up-to-date baggage fees and information. ALX is not responsible for any additional fees incurred for baggage or seating. Clients are responsible for making arrangements and covering the cost to store any excess baggage. Please note, luggage and personal belongings are carried at the owner's risk throughout the journey. ALX is not liable if baggage is not permitted for transport.
Booking and Acceptance
Contractual Agreement
When you submit a signed Booking Form, it confirms your understanding and acceptance of these Terms and Conditions, as well as those of any third-party service providers. This includes a representation that you have the authority to make this agreement on behalf of all individuals listed in your Travel Party.
Non-Residency Clause
These Terms and Conditions are applicable to travellers who are not residents of South Africa. All arrangements, payments, and formalities (e.g., obtaining visas) should be completed prior to your arrival in South Africa.
Third-Party Suppliers
ALX is a travel booking agent, not a tour operator. As your Booking Agent and on your behalf, we contract and operate with the relevant service providers subject to the specific terms and conditions of property owners, suppliers, and other travel-related operators (hereinafter referred to as ‘Third-Party Suppliers’).
The guest acknowledges that by signing and submitting the Booking Form, they accept and agree to be bound by these Terms and Conditions in relation to and on behalf of all members of the travel party as stipulated in the Booking Form (‘the Travel Party’) and that they are likewise authorised to sign the Booking Form and the terms and conditions of the
Supplier Terms:
Services provided by third-party suppliers (e.g., hotels, airlines, transportation companies, and guides) are governed by the respective terms and conditions of those suppliers. These terms will form a direct contractual relationship between you and the supplier. We recommend that you review their terms, as they will govern your rights in the event of service disruptions.
Payments and Cancellations:
Reservations:
Bookings are confirmed once we receive a signed Booking Form and a 50% deposit of the total invoiced amount. This deposit covers the costs of securing accomodation, services with third-party suppliers and our planning and coordination fees.
Payment Breakdown:

ALX Experience Fee: A non-refundable commitment, planning and coordination fee.

Third-Party Securing Fee: 50% of the total cost (or full payment for flights) will be paid directly to the third-party suppliers.

Seasonal Adjustments: During peak seasons, higher deposits may be required, and some services may require full payment up to six months prior to the travel date.

Final Payment: Full payment is due 90 days prior to departure. Failure to pay on time will result in cancellation of the booking.
Cancellation Policy:
The following cancellation fees will be payable if the booking is cancelled:

50% of the confirmed total booking value if the booking is cancelled more than 81 days prior to the date of arrival.
-
100% of the confirmed total booking value if the booking is cancelled 80 – 0 days prior to the date of arrival or in the case of a no-show.
Cancellation fees may differ due to specialist product and/or peak season travel. Airline reservations are 100% non-refundable.
Failure to make a final payment within the contracted timeframes described in your itinerary shall be deemed a cancellation by you, in your sole discretion. Additionally, you will also be responsible for any costs imposed on ALX by suppliers resulting from late payments.
ALX reserves the right to cancel any tour before departure, in which event the entire payment will be refunded to the Client without any further obligation on the part of the Company or right of recourse by the Client. Clients should also refer to the cancellation provisions contained in the Third-Party Supplier’s T&C or website. Third-Party Suppliers may charge cancellation fees over and above those stated above:
Payment Methods:
ALX accepts two payment methods:
Wire transfer to one of our denominated accounts (USD, CAD, EUR, or GBP).
Credit card payment via a secure payment link. ALX accepts all major credit cards (Visa, Mastercard, American Express, etc.). Please note we do not currently accept Diners Club. All Credit Card Payments are subject to a 3.5% CC fee.
Chargeback Policy
To complete a reservation, travelers must provide authorization for each transaction, either by clicking a checkbox or signing a consent form. This authorization signifies your agreement to our Terms and Conditions, including our cancellation policy.
Before initiating any chargebacks, we ask that you contact us directly to discuss any concerns regarding your charges. We are committed to resolving any issues that arise and will work with you to reach a satisfactory outcome. However, we reserve the right to dispute any chargebacks we deem improper and recover related costs, including legal fees.
Improper chargeback scenarios include, but are not limited to:

Non-cancellable reservations: Chargebacks are not permitted for non-cancellable bookings, regardless of whether the reservation is used.

Authorization by third parties: Chargebacks due to charges authorized by family, friends, or other third parties who have access to your credit card are not allowed (except in cases of fraud).

Supplier product discrepancies: Chargebacks related to inconsistencies or inaccuracies in the product description by the supplier are not accepted.

Force majeure or external circumstances: Chargebacks resulting from events beyond our control, such as natural disasters or government restrictions, will not be honored.
-
Disagreement with the cancellation policy: If you do not agree with our cancellation terms, chargebacks are not permissible.
In the event of an improper chargeback, we reserve the right to cancel any associated reservations and take appropriate action to recover the costs incurred.
By using our service to make a reservation, you acknowledge and agree to this chargeback policy, as well as our cancellation terms.
Travel Insurance Requirement and Responsibility
It is strongly advised, and it is the guest’s responsibility to take out their own comprehensive, full-cover insurance at the time of confirming their trip, covering themselves for personal effects, personal accident, medical and emergency travel expenses, loss of luggage, cancellation, and curtailment. Note that cancellation policies and penalties from Third-Party Suppliers are strictly enforced. Travel insurance should be comprehensive and should cover unforeseen situations that might affect your ability to fulfil your travel obligations.
ALX cannot be held liable for any cancellation, medical, or unforeseen circumstances, which may have an effect on international, domestic, or regional flights or the continuation of your trip, booked with ALX. Please ensure your travel insurance covers private hospitals in the countries you are travelling to and that you have read the policy terms (i.e., some hospitals may require a cash deposit upfront).
Should the insurers dispute their liability for any reason, the guest will have recourse against the insurers only. Once the insurance has been confirmed and paid for, the guest will be issued with a policy document from the insurer. It is a complex document, which must be read before you initiate your travel so that you can address any queries you may have to the insurer prior to your departure.
Please note that various credit card companies offer limited levels of travel insurance, which ALX does not consider sufficient cover for international travel. Kindly check with the respective credit card companies in order to obtain the specific details of the cover.
Force Majeure
Definition and Implications
Neither ALX nor its suppliers will be held responsible for delays or cancellations due to force majeure events, including natural disasters, strikes, wars, epidemics, pandemics, government regulations, or any other events beyond our reasonable control.
Procedural Steps
If a force majeure event occurs, we will work to reschedule your trip or provide a refund, where possible, based on recoverable funds from suppliers. It is your responsibility to notify us in writing as soon as you are aware of any force majeure event that may impact your travel.
Force Majeure (Expanded)
In addition to the typical events covered by Force Majeure (e.g., natural disasters, war, strikes, or pandemics), the following are also considered Force Majeure events:
Government regulations or restrictions
Acts of terrorism or civil unrest
Environmental hazards (e.g., wildfires, flooding, etc.)
Unforeseen travel disruptions due to changes in transportation availability
In the event of a Force Majeure, ALX will make every effort to reschedule, refund, or offer an alternative travel experience, subject to supplier availability and recoverable funds. However, we cannot be held liable for any losses that occur as a result of such events.
Passports, Visas, and Health
Documentation Requirements and Visa Compliance
Valid passports are required for all international destinations. Please note that guests are responsible for obtaining the required documentation applicable for entry. Passports must be valid for six (6) months after the return of your journey and should also have sufficient blank pages for visas and immigration stamps. For travel to South Africa, guests must have a minimum of two blank pages in their passport for visas and immigration stamps. ALX cannot be held responsible should you be denied entry to a country due to non-compliance with these requirements. A copy of your valid passport must be submitted to ALX in order to confirm air reservations made through ALX.
It is furthermore entirely the Guest’s duty to ensure that any vaccinations, inoculations, prophylactic (e.g., for malaria), and the like, where required, have been obtained. Please check the requirements with a medical practitioner who is well versed with the prevailing conditions and requirements of the country(ies) you intend visiting before travelling. If the Company assists the Client in any way, such assistance will be at the Company’s sole discretion, and the Client acknowledges that in doing so, the Company is not assuming any obligation or liability, and the Client indemnifies the Company against any consequences of such assistance. It is the Client’s duty to familiarise him/herself with the inherent dangers of and mental and/or physical challenges the journey may entail, and the Client must accordingly be in an adequate condition for the Proposed Travel Arrangements.
Please note that all visitors to South Africa and all clients who are travelling from RSA to another country are required to have a minimum of three (3) blank pages in their passport excluding the front and back cover to enable the entry visa to be issued. However, in each case, a further enquiry should be addressed to the consulate or embassy of the relevant countries being visited. If there is insufficient space in the passport, entry will be denied, and the person is likely to be detained pending return to their country of origin. Please ensure that all passports are renewed timeously. The client must ensure that the details supplied to the Company mirror those details shown on their passport for international travel and ID documents for local travel.
Please note that a visa does not guarantee entry to any given country at the point of entry, and boarding of an aircraft may be denied at any point even if you have a valid visa. Furthermore, caution should be taken when your countries of transit or final destination issue visas on arrival. These must not be taken for granted, and ensure that all details are obtained from the relevant embassy or consulate well in advance of your departure.
Should you travel while pregnant, please contact your doctor for a “fit to travel” letter, which is required by some service providers. Please advise the Company how far along your pregnancy is when traveling, as some service providers have restrictions.
ABRIDGED BIRTH CERTIFICATES FOR CHILDREN – PLEASE CONSULT THE DEPARTMENT OF HOME AFFAIRS OR EMBASSY OR CONSULATE IN YOUR COUNTRY ABOUT THE LATEST REQUIREMENTS.
Travel advisories
It is the responsibility of the traveler to become informed about the most current travel advisories and warnings by referring to the U. S. State Department’s travel website at travel.state.gov or by phone at 888 407 4747. In the event of an active State Department Travel Warning against travel to the specific destination location(s) of the experience, should the traveller still choose to travel, notwithstanding any travel advisory or warning, the traveller assumes all risk of personal injury, death or property damage that may arise out of the events like those advised or warned against.
Malaria and Tropical Diseases
Certain parts covered by your itinerary are areas where there is a high risk of malaria and other tropical diseases. The Company strongly recommends that the necessary precautions be taken in this regard and recommends that you check with your medical practitioner before departure or a medical practitioner well versed in tropical diseases immediately upon your arrival in Africa or any other tropical or sub-tropical destination. If you have not done so prior to departure, it is imperative you do so upon your return.
Certain areas also require Yellow Fever Vaccinations of which the certificate must be carried and produced when required. Yellow Fever Vaccinations last for up to 10 (Ten) years and inoculation is required at least 2 (Two) weeks before your departure from the country of origin. PLEASE NOTE: The South African government, as a rule, does not issue cautionary travel advice regarding foreign countries – where the countries you are travelling to issue such a cautionary and it comes to the Company’s attention, it will convey it and/or provide an appropriate link to you. However, it is your duty to check your destination on the Internet for any such cautionary information before you travel as the state of the country in terms of not only health but also security (such as recent terrorist attacks) can change overnight.
Client Conduct
As a guest of ALX, you are expected to behave in a manner that is respectful to other guests, staff, and the destinations you visit. You agree not to engage in any disruptive, unsafe, or unlawful conduct during your trip. If your behavior is deemed inappropriate or harmful to the well-being of others, or if you violate local laws, you may be removed from the experience, and no refunds or compensation will be offered. You are solely responsible for any personal injury, property damage, or legal consequences arising from your conduct.
Privacy and Data Protection
ALX is committed to protecting your privacy. We will use the information you provide solely for the purpose of delivering our services and fulfilling your travel experience. Governing Law and Dispute Resolution
These Terms and Conditions are governed by the laws of the jurisdiction where ALX is registered. Any disputes arising out of or in connection with these Terms and Conditions, your booking, or any aspect of your trip will be resolved through arbitration or mediation, in accordance with the rules of the relevant legal authority. Legal proceedings may take place in the jurisdiction where ALX is based, unless otherwise agreed by both parties.
Limitation of Liability and Risk
Alive Group LLC (trading as ALX), its subsidiaries, its employees, shareholders, officers, directors, successors, agents, and assigns (collectively “ALX”), does not own or operate any entity which provides goods or services for your experience. It purchases transportation (by aircraft, coach, train, vessel, or otherwise), hotel and other lodging accommodations, restaurant, ground handling, and other services from various independent suppliers. All such persons and entities are independent contractors. As a result, while the Company selects such independent suppliers with the utmost care, ALX is not liable for any negligent or willful act of any such person or entity or of any third party.
Furthermore, and without limitation, ALX is not responsible for any injury, financial or physical loss, death, inconvenience, delay, or loss of or damage to personal property in connection with the provision of any goods or services, whenever and however the same may occur. This includes, but is not limited to, any act, omission, default, or negligence on the part of ALX, acts of God or force majuere, illness, trauma, disease, acts of war, civil unrest, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of services, food poisoning, mechanical or other failure of aircraft or other means of transportation, or failure of any transportation mechanism to arrive or depart on time, delays, or inconvenience. The Client indemnifies and holds harmless ALX accordingly and irrevocably waives any claims as aforesaid. The Indemnified Parties shall furthermore not be liable for any consequential, indirect, or economic loss or damage whatsoever, unless section 61 of the Consumer Protection Act applies.
There are many inherent risks in adventure travel of the type involved here, which can lead to illness, injury, or even death. These risks are increased by the fact that these experiences take place in remote locations, far from medical facilities. The passenger assumes all such risks associated with participating in these experiences and the entire journey.
Travel Documentation and Emergency Services
In case of emergencies during your trip, ALX can assist you with coordination of local emergency services, but it is your responsibility to have appropriate emergency contact numbers and be familiar with local emergency procedures. We also recommend that you have a travel backup plan, including emergency contacts and access to funds in the event of an unforeseen situation.
Miscellaneous
Severability: If any provision of these Terms and Conditions is found to be illegal, invalid, or unenforceable, the remainder of these Terms and Conditions will remain in effect.
Entire Agreement
These Terms and Conditions represent the entire agreement between you and ALX, superseding all previous communications or agreements, whether oral or written.
Assignment
ALX may assign its rights or obligations under these Terms and Conditions to any affiliate or third-party service provider without notice. You may not assign your rights or obligations without the express written consent of ALX.
Amendments
ALX reserves the right to modify or amend these Terms and Conditions at any time. Any updates will be posted on our website and become effective once posted.
Confirmation and Acknowledgment
By submitting your signed Booking Form and making a payment, you confirm that you have read, understood, and agree to these Terms and Conditions, as well as those of any third-party suppliers, for yourself and on behalf of all members of your travel party.
Changes to Terms and Conditions
ALX reserves the right, in our sole discretion, to modify these Terms and Conditions at any time. Updated versions of the Terms and Conditions will be posted on this website and will become effective immediately upon posting. We encourage you to check this page frequently to stay informed of any changes. The Terms and Conditions in effect at the time of your booking will apply to your booking. We retain the right to amend these Terms and
